Islamabad High Court hears One Constitution Avenue appeal

Islamabad, Pakistan – Web Desk: The Islamabad High Court Islamabad High Court heard an intra-court appeal related to the One Constitution Avenue apartment case, where sub-lease holders are seeking relief in a long-running property and lease dispute involving the Capital Development Authority.

During proceedings, the court questioned legal inconsistencies surrounding lease cancellation and the status of residential occupants after termination of leases. The bench noted that policy decisions and committee formations by the Prime Minister’s office could raise legal questions if not properly challenged.

Lawyers representing the Capital Development Authority argued that once leases are cancelled, ownership of the property reverts to the authority under existing regulations. The court, however, raised concerns about whether affected residents were formally issued eviction notices.

Counsel for the appellants urged the court to grant interim relief, citing reports of police involvement and forced actions at the site. The bench observed that the building remains in place and asked both sides to clarify the intended legal outcome.

The case also involves prominent appellants including former officials who have challenged earlier rulings. The court has directed the CDA to seek instructions and submit a written response before the next hearing.

The matter was adjourned until May 25 for further proceedings.
