Indus Waters Treaty Arbitration Backs Pakistan’s Position on Treaty Status
THE HAGUE, NETHERLANDS — WEB DESK: A Court of Arbitration constituted under the 1960 Indus Waters Treaty has issued a significant award concerning the treaty’s legal status following India’s decision to place the agreement “in abeyance”, alongside an order on interim measures concerning the Ratle Hydroelectric Plant. The ruling supports key elements of Pakistan’s legal position regarding the continuing operation of the treaty.
The award was issued on August 31, 2026, in the Indus Waters Western Rivers Arbitration between Pakistan and India. The Permanent Court of Arbitration (PCA) serves as the secretariat to the Court of Arbitration; the PCA itself is not the tribunal deciding the dispute.
The proceedings concern the interpretation and application of the Indus Waters Treaty to Indian run-of-river hydroelectric projects on the Indus, Jhelum and Chenab rivers and their tributaries, before those waters flow into Pakistan.
The latest phase arose after India announced on April 23-24, 2025 that the Indus Waters Treaty would be held “in abeyance with immediate effect”. The Court had previously considered whether that Indian decision affected its authority to continue hearing Pakistan’s case. In a June 2025 supplemental award, it addressed the consequences of India’s announcement for the tribunal’s competence.
Pakistan subsequently sought interim measures and a determination of the treaty’s status. A three-day hearing on those questions concluded on April 28, 2026, according to the PCA.
On August 31, the Court issued an Award on the Status of the Indus Waters Treaty in Respect of India’s Decision on Abeyance and a separate Order on Pakistan’s Interim Measures Application, specifically concerning the Ratle Hydroelectric Plant. Both decisions are listed in the PCA’s official case record.
The Express Urdu analysis describes the ruling as a victory for Pakistan’s position and argues that the treaty cannot be unilaterally suspended or altered. The underlying PCA record confirms that the tribunal has ruled on the treaty’s status following India’s abeyance decision, although describing the entire dispute simply as a final “Pakistan victory” would be broader than the procedural record warrants: PCA Case No. 2023-01 remains listed as pending.
The dispute also involves technical questions over the design and operation of Indian hydroelectric projects on the western rivers. In August 2025, the Court issued an award dealing with general interpretation of the treaty, including Article III and provisions of Annexure D governing new run-of-river hydroelectric plants. India has not participated in the arbitration and has challenged the Court’s competence.
In May 2026, the Court also issued a supplemental award dealing with maximum pondage, another technical issue affecting hydroelectric projects governed by the treaty.
The distinction between the Court of Arbitration proceedings and the separate Neutral Expert proceedings is important. The PCA currently lists both processes: Pakistan initiated the arbitration under the treaty, while separate proceedings requested by India are being handled by Neutral Expert Michel Lino.
The Indus Waters Treaty therefore remains the central legal framework governing the two countries’ water relationship, while the wider arbitration continues. The August 31 award represents an important ruling on whether unilateral action by one party can alter the treaty’s operation and the dispute-resolution process established under it.
