Federal Constitutional Court Says Civil Servants Must Resist Political Pressure
ISLAMABAD, Pakistan — October 20, 2026: Pakistan’s Federal Constitutional Court has emphasised the importance of an independent civil service, invoking Quaid-e-Azam Muhammad Ali Jinnah’s guidance that government officials should perform their duties without political pressure.
In a judgment authored by Justice Ali Baqar Najafi, the court dismissed an appeal filed by police service officer Tanveer Ahmed Tahir against the denial of promotion from Grade 19 to Grade 20.
The judgment drew on Jinnah’s address to civil officers in Peshawar in April 1948, which stressed that civil servants should remain impartial and serve the state and the public with integrity.
Court Clarifies Rules on Repeated Promotion Deferments
The 19-page judgment addressed the treatment of civil servants whose promotion cases are repeatedly deferred by the Central Selection Board.
According to the reported ruling, repeated deferments cannot be used to postpone consideration of an officer’s promotion indefinitely. However, the court also clarified that three successive deferments do not automatically entitle a civil servant to promotion.
The decision establishes an important distinction between an officer’s right to fair consideration under the applicable rules and an automatic entitlement to advancement.
Background of the Promotion Dispute
Tanveer Ahmed Tahir challenged the Islamabad High Court’s February 15, 2022, decision, which had upheld the denial of his promotion and the advancement of junior officers.
Tahir joined the Police Service of Pakistan after passing the Central Superior Services examination in 1999. He was promoted to Grade 18 in June 2007 and Grade 19 in January 2015.
His promotion case was subsequently affected by pending accountability proceedings. Although he was acquitted in one reference by the Sindh High Court in November 2019 and reinstated in January 2020, the Central Selection Board later considered his promotion in the context of another pending reference.
The board deferred his advancement, while junior officers were promoted.
Quaid-e-Azam’s Guidance on Civil Service
The court referred to Jinnah’s emphasis on impartiality, integrity and freedom from political influence in public administration.
The principles highlighted in the judgment underscore the importance of civil servants carrying out their responsibilities according to the law and applicable service rules rather than political considerations.
The ruling also clarifies that fair consideration for promotion does not remove the need to satisfy the relevant eligibility criteria and promotion requirements.
