SC rejects govt appeals, rules wrongfully terminated staff entitled to all pending payments.
Islamabad, Pakistan – Web Desk: The Supreme Court of Pakistan delivered a landmark verdict, ruling that wrongfully terminated employees are entitled to full pending salaries and dues. Government appeals against prior tribunal decisions were dismissed. The ruling specifically restores rights to Khyber Pakhtunkhwa police officers, ordering payment within one month.
The judgment cited constitutional guarantees under Articles 9 and 10-A, emphasizing that employment termination must have solid, reasonable justification, and discretionary powers cannot be misused. The court stressed that employees should not suffer due to administrative delays, and the burden of proof lies with the department, not the worker.
Supreme Court Justice Shahid Waheed authored the judgment for a five-member larger bench, referencing Shakespeare: “Depriving someone of sustenance is equivalent to depriving life.”
